Choosing an EU-hosted LLM in 2026: what is actually on the menu

GPAI enforcement is now live and Mistral shipped real product news this month. Here is an honest map of which language models are genuinely EU-owned, which are just EU-hosted, and which give you neither.

"Just use an EU model" is the kind of sentence that sounds like an answer and isn't. It skips the actual question, which is: EU-owned, or just EU-hosted, and does that distinction even matter for what you're building? Both halves of that question got sharper this month, so here is the honest, current map.

What actually changed this month?

Two things. First, enforcement for general-purpose AI models has been live since 2 August 2026: the Commission can now request a provider's technical documentation, get access to a model for evaluation, and require corrective measures, including recalls (Latham & Watkins). Signing the EU's General-Purpose AI Code of Practice is voluntary, but it buys a documented compliance path and counts as a mitigating factor if a provider ever gets fined (artificialintelligenceact.eu). That makes "did our vendor sign it" a real due-diligence question now, not a nice-to-have.

Second, Mistral, the closest thing Europe has to a flagship LLM provider, shipped real product news in September: OCR 4.1 went generally available at €3.50 per 1,000 pages with bounding boxes and confidence scores, alongside a new Agentic Search retrieval layer and more than 20 connectors including Google Drive and GitHub (getaibook.com). That builds on the roughly €723 million (about $830 million; ECB reference rate on 30 March 2026, €1 = $1.1484) in debt financing Mistral raised in March from a consortium including Bpifrance, BNP Paribas and Crédit Agricole, to buy 13,800 Nvidia GPUs and 44MW of power for a data centre near Paris, with a stated goal of 200MW across Europe by the end of 2027 (DataCenterDynamics, CNBC). The infrastructure and the product roadmap are catching up to the marketing at the same time enforcement teeth arrive. Worth a fresh look.

Is "EU-hosted" one thing?

No, and collapsing it into one thing is the mistake I see most often. It forks three ways, and the fork runs on two separate questions: who legally owns the company behind the model, and whether an EU-region host actually exists for the specific model version you plan to call.

Picking a model forks three ways, and the fork runs on who legally owns the provider and whether an EU-region host exists for that exact model, not on the word 'EU' in a brochure. Only an EU-incorporated provider closes the CLOUD Act gate; an EU-region host on a US-owned model buys residency, not sovereignty; and some model versions still have no EU host at all.

I wrote the residency-versus-sovereignty distinction up properly in an earlier post: an EU data centre answers where the bytes sit, not who can be legally compelled to hand them over under the US CLOUD Act. The same logic applies to picking a model, it just changes what you're choosing between.

Which models are genuinely EU-owned?

Two real answers, and one honest asterisk. Mistral AI is French, privately held, and runs its own European infrastructure end to end, which is the cleanest "no CLOUD Act exposure" answer on the market today.

Aleph Alpha is the other one, and it comes with a caveat worth stating plainly. Its enterprise platform, PhariaAI, runs on Schwarz Group's STACKIT cloud in Germany with no US hyperscaler at any layer, which is a genuinely sovereign infrastructure stack (Futurum Group). But Aleph Alpha merged with Canada's Cohere in April 2026. The infrastructure is still German; the parent company is no longer purely European. If a client's requirement is "no non-EU parent, full stop," check the current ownership yourself rather than trusting last year's press release. Marketing language ages faster than corporate structures change, and sometimes it's the other way round.

Can you keep Claude, GPT or Gemini inside the EU?

Yes, for residency. No, for sovereignty. And it depends on which model version, so check before you build.

Claude runs in-region through AWS Bedrock in Frankfurt, Dublin, Paris and Stockholm, and through Google Vertex AI's EU regions, but Anthropic's own direct API defaults to US hosting, and Claude on Microsoft Foundry still has no EU data zone as of late August 2026 despite being listed as "coming" (Requesty's regional breakdown). OpenAI now offers data residency in Europe for the API and for ChatGPT Enterprise through eu.api.openai.com, alongside the UK, US, Japan, Canada and several other regions (OpenAI). Google's Gemini gets regional pinning through Vertex AI across Belgium, the Netherlands, Finland and several other EU locations, but that guarantee does not automatically carry over to every new model release the day it ships (Google Cloud's own data residency docs).

The pattern across all three: the platform having an EU region is not the same as the specific model you're calling being available in it. Check the model's own documentation page, not the platform's homepage.

Does the Code of Practice actually matter to you as a buyer?

More than it did in August. Just over two dozen organisations have signed the GPAI Code's full three chapters, including Amazon, Anthropic, Google, IBM, Microsoft, Mistral AI and OpenAI (xAI has signed only the Safety and Security chapter) (the Commission's own GPAI Code of Practice page). That is a much shorter list than the roughly 190 signatories of the EU's separate Code of Practice on AI-generated content transparency, a different voluntary code entirely, worth naming because the two get confused. Meta has not signed the GPAI Code, and neither have the major Chinese labs, Alibaba, Baidu or DeepSeek. That doesn't make an unsigned model unusable. It does mean you're relying on your own contract and DPA to cover ground the Code would otherwise cover for you, which is a fair trade-off for some use cases and a real gap for others, especially once a model touches anything a regulator would call high-risk later.

So what should you actually pick?

Three honest defaults, by situation. No specific compliance requirement and cost or capability drives the decision: pick whichever model does the job best, EU-owned or not, and don't pay a sovereignty premium you don't need. You need EU data residency because a client contract or a DPIA calls for it, but not full sovereignty: any of Claude, GPT or Gemini through their EU regions is a defensible, normal choice, same logic as the F2-versus-F4 capacity decision I wrote up for Fabric. You are in a genuinely sensitive sector, health data, biometric data, public-sector procurement that specifically requires an EU-only legal chain: Mistral is the cleanest answer today, and Aleph Alpha is a strong second if the Cohere ownership question doesn't disqualify it for your case.
